What Is Proposition 65

The Safe Drinking Water and Toxic Enforcement Act of 1986 (also known as Proposition 65 or Prop 65) was an initiative approved by California Voters to address the growing concerns about exposure to toxic chemicals.  This environmental protection law requires business that sell products in the state of California to notify consumers about significant amounts of chemicals in the product they purchased. These warnings come in the following forms:

  • Physical warning labels Kotis applies to all products shipping within California. Warning label will look like this:

            

  • Website warnings that pop up on the checkout page if a California address is listed as the delivery address

Prop 65 requires the State to publish a list of chemicals known to cause cancer or birth defects or other reproductive harm. The most common chemicals found on this list in promotional products are BPA, lead and phthalates. Some common promotional items on the list include certain makes of sunglasses, earbuds and drinkware. 


How This Impacts Your Shipments

For all Kotis produced merchandise, Kotis handles confirming with vendors if items require Prop 65 labeling. The label will be affixed to either the actual product and/or individual packaging the product comes in.


Non Kotis Produced Merchandise

For non-Kotis produced merchandise, the client is required to do their due diligence to research with their vendor if the items they are purchasing are Prop 65 compliant. Client must communicate whether the items require Prop 65 labelling when sending product to our warehouses.
